Terms of Service
These terms are the agreement between Sunnyside Kitchen Systems ("Sunnyside", "we", "us") and the restaurant or business ("you") that uses our software. By creating an account or using the app, you agree to them on behalf of your business. If you are an employee using an account your employer set up, your employer is the customer and these terms apply to your employer's use.
The service
Sunnyside is software for running a restaurant kitchen: inventory, food cost, prep, training, tasks and catering, on the iPad app and on the web. We may add, change or remove features over time. We will tell you ahead of time about changes that remove something you rely on.
Your account
You are responsible for the people you give access to, for keeping logins and PINs private, and for what happens under your accounts. Give each person only the access their job needs. Tell us right away if you think an account has been misused.
Your information
Everything you put into Sunnyside stays yours. You give us permission to store it, process it and show it to the people you choose, only so that we can run the service for you. How we handle personal information is described in our Privacy Policy. You are responsible for having the right to enter your team's information, including what your local employment and privacy laws require.
Using the service responsibly
- Don't break the law, or use Sunnyside to store or share anything unlawful.
- Don't try to get into another restaurant's information, probe or attack the service, or overload it.
- Don't copy, resell or reverse engineer the software, except as the law allows.
- Check the numbers that matter. Food cost, nutrition, allergen, safety and pay figures depend on what your team enters, and AI features can make mistakes. You remain responsible for your food safety and your decisions.
Fees and cancelling
Paid plans are billed per restaurant location, as agreed with you when you sign up. You can cancel at any time and the plan ends at the close of the period you have paid for. Unless we agree otherwise in writing, fees already paid are not refunded.
Third-party services
Sunnyside can connect to other services you use, such as your point-of-sale system. Those services have their own terms, and we are not responsible for them.
Availability and changes
We work hard to keep Sunnyside running and to back up your information, but we cannot promise it will always be available or free of errors. We may suspend an account that breaks these terms or puts the service or other customers at risk.
Our responsibility
The service is provided "as is." To the fullest extent the law allows, we are not liable for lost profits, lost sales or indirect damages, and our total responsibility for any claim is limited to the fees you paid us in the 12 months before it. Nothing here limits liability that the law does not allow to be limited.
Ending the relationship
You can stop using Sunnyside at any time and ask us to delete your restaurant's information. We may end the service to you with reasonable notice, and right away for serious misuse. Sections that are meant to continue after the end, such as ownership of your information and our limits of responsibility, do.
Changes to these terms
If we change these terms, we will post the new version here with a new effective date and tell restaurant owners about important changes. Using Sunnyside after a change means you accept it.
